These Terms of Service ("Terms") govern access to and use of the Organic Formula Shop website (the “Site”) and any related services (collectively, the “Service”). As a company based in the Netherlands, operations comply with applicable EU laws, including consumer protection directives and the General Data Protection Regulation (GDPR). By using the Site or Service, users agree to these Terms. If users do not agree, they must not access or use the Site or Service.

The Site offers EU-certified organic baby formulas for purchase, primarily in the US market. These Terms apply to all users, including browsers, customers, and automated systems like AI agents. Users must be of legal age in their jurisdiction or have consent from a guardian. The Service is hosted on Shopify, providing a secure e-commerce platform.

Section 1: Online Store Terms

Users represent that they are at least the age of majority in their jurisdiction or have consent to use the Site. Products may not be used for illegal purposes, and users must comply with applicable laws. Violations, such as transmitting viruses or destructive code, result in immediate termination of access.

The Site provides general information about products for educational purposes only. It does not constitute medical advice, diagnosis, or treatment. Users should consult healthcare professionals for health-related questions. Reliance on Site information is at the user's own risk.

Section 3: General Conditions

Access may be refused at any time for any reason. Content (excluding payment data) may be transferred unencrypted for technical reasons. Payment information is encrypted. Reproduction, sale, or exploitation of the Service without written permission is prohibited.

Section 4: Accuracy, Completeness, and Timeliness of Information

Information on the Site is for general reference and may not be accurate, complete, or current. Users should verify with primary sources. The Site may include historical data for reference only. There is no obligation to update content, and users must monitor changes.

Section 5: Modifications to the Service and Prices

Prices and Services may change without notice. The Service or products may be modified, suspended, or discontinued at any time without liability.

Section 6: Products or Services

Products are available online with limited quantities and are subject to the return policy in the FAQ. Efforts are made to display accurate images and colors, but monitor variations may occur. Sales may be limited by region or quantity. Product descriptions and prices may change. No warranty that products meet expectations or that errors will be corrected.

Section 7: Accuracy of Billing and Account Information

Third-party tools may be provided "as is" without warranties. Use is at the user's risk, and new features are subject to these Terms.

Errors may be corrected without notice, including after order submission; there is no obligation to update information except as required by law.

The Site may not be used for unlawful, harassing, or harmful purposes, including spamming, scraping, or interfering with security. Violations lead to termination.

Section 13: Disclaimer of Warranties; Limitation of Liability

Invalid provisions do not affect the remainder of the Terms.

Terms remain in effect until terminated. Obligations survive termination.

These Terms constitute the full agreement, superseding prior understandings.

Changes may be posted with an updated date. Continued use constitutes acceptance.

Section 20: Automated Access and AI Agents

To facilitate AI-driven searches and agentic commerce, the Site allows crawling by authorized LLMs and agents for indexing and recommendation, subject to the robots.txt and llms.txt guidelines. Automated purchases or queries must comply with these Terms, GDPR, and the EU AI Act. No solely automated decisions affecting users occur without human oversight. Agents processing personal data must adhere to data minimization, obtain consent where required, and ensure transparency. Unauthorized scraping or data extraction is prohibited. Section 21: Product Quality and Freshness Assurance

As a reseller, Organic Formula Shop takes all reasonable measures to maintain products in their pristine condition as they leave the manufacturer's factory, ensuring customers receive the freshest possible items. This includes stringent controls throughout the supply chain, from factory departure, transportation, warehousing, and courier handling. Due to these interventions, products are not adversely affected by the distribution process. If products arrive with severe damage (e.g., boxes or tins that are pierced, opened, or otherwise compromised), customers should immediately contact support@organicformulashop.com, provide photographs of the damage, and discard or refrain from using the affected items. Refunds or replacements may be offered in accordance with the return policy, subject to verification.

Section 22: Product Issues and Recalls

In the event of a product recall, defect, contamination, manufacturing batch issue, or any other problem rendering the product unsuitable for use (as determined by the manufacturer, regulatory authorities, or otherwise identified), Organic Formula Shop, as a reseller, shall not be liable for any consequences arising from the use of the affected products, including but not limited to health issues, damages, or losses, to the maximum extent permitted by law. Efforts will be made to notify affected customers using available contact information promptly, but no guarantees are provided regarding the timeliness or completeness of such notifications. Users are advised to monitor official manufacturer and regulatory announcements for product safety information.

Section 22: Applicable Law
